Terms and Conditions of Seek Adventure
1. General Information
Please read these Terms and Conditions carefully. They form an important part of the agreement regarding participation in outdoor activities provided by Seek Adventure. By completing a booking, the customer enters into a binding contract with Seek Adventure and agrees to these Terms and Conditions.

These Terms and Conditions apply to all outdoor activities provided by Seek Adventure (the “Company”), including but not limited to e-bike tours and hiking trips.
2. Booking and Payment
2.1 Booking
- Bookings can be made through our online booking system, by email, or by phone.
- The person making the booking confirms that they are authorized to act on behalf of all members of their group and that all participants agree to these Terms and Conditions.
- After booking, the customer will receive a booking confirmation containing the basic information about the booked service.
- We recommend booking well in advance to ensure availability. We cannot guarantee a free slot if earlier bookings have already been made. The earlier the booking, the higher the chance of getting the desired date.
- By completing the booking, the customer enters into a binding contract with Seek Adventure and agrees to these Terms and Conditions.
- Participants must provide a valid phone number and email address to receive timely information in case of changes or cancellations, e.g., due to bad weather.
- Participants are responsible for providing accurate personal information and for checking the details stated in the booking confirmation. Any discrepancies must be reported immediately. Costs arising from incorrectly provided information are the responsibility of the customer.
- Some tours require a minimum number of participants. If the minimum is not met, the tour may be canceled, replaced with an alternative, or refunded.
2.2 Payment
- The total amount for the tour or activity must be paid in full before the activity starts, unless otherwise agreed.
- If payment is not made on time, the company reserves the right to withhold the service.
- Payment can be made by credit card or bank transfer at the time of booking.
- Last-minute bookings are possible; payment may be made in cash or by credit card on site.
2.3 Planning of Individual (Private) Tours
- For private tours tailored to customer requirements, a fee is charged for creating the custom itinerary.
- This fee is due within 3 business days of receiving the itinerary proposal. If the fee is not paid within the given period, the booking is considered invalid.
- The itinerary fee includes all applicable taxes at the time of issue. In case of tax rate changes, Seek Adventure reserves the right to adjust the total amount according to current legislation.
3. Subject of the Contract
- The subject of the contract is the ordered activity or tour provided by Seek Adventure as described in its offer.
- The company undertakes to provide the service as described, and the participant undertakes to pay the agreed price.
- Based on agreement, additional services may be provided, with the participant bearing all related costs.
4. Prices
- All prices are per person and in Swiss francs (CHF), including VAT.
- Prices may change without prior notice.
- The price includes transfer from the hotel or other accommodation in the Interlaken area to our base for tour preparation (including equipment and instructions). For participants staying outside the Interlaken area, the nearest meeting/pick-up point will be arranged.
- The price does not include personal expenses such as phone calls, beverages, tips, or other items unless explicitly stated otherwise.
- We recommend customers carefully read the description of each tour to see what is included in the price.
5. Cancellation and Refund Policy
5.1 Cancellation or Change by the Customer
- No refund is given if a participant arrives late or leaves early.
- If a participant wishes to change the booking date, this is only possible if there is availability. There is no guarantee that the desired day will be available. If the change is not possible, the original cancellation conditions apply, and the participant bears full responsibility for the payment.
- Changes or cancellations must be made in writing (by email) and are valid only upon confirmation by Seek Adventure.
- In some cases, changes may incur additional costs, which the customer will be informed of in advance.
- If the booking includes a third-party service (e.g., accommodation as part of a private tour), the cancellation terms of the third-party provider may apply, which may differ from our conditions. The participant is fully responsible for any applicable cancellation fees charged by the third party.
5.2 Changes by the Company
- The company reserves the right to make necessary changes to the program, services, or itinerary if required by circumstances beyond its control (e.g., bad weather, unavailability of third-party services, safety reasons, road closures, traffic jams, natural disasters, or other unforeseen events).
- If needed, the company reserves the right to modify the route, schedule, or other program details to ensure participant safety or to best continue the service.
- In the event of changes, participants will be informed as soon as possible and offered a suitable alternative or partial refund if the service cannot be adequately replaced.
5.3 Cancellation Conditions for Regular Tours
Free cancellation possible up to at least 7 days in advance.
Shortened refund deadlines:
- 30 to 7 days: 100% refund
- 6 to 3 days: 50% refund
- 48 hours or less: No refund
5.4 Cancellation Conditions for Private Tours
Free cancellation possible up to 14 days in advance.
Cancellation fees:
- 14 to 7 days: 50% refund
- 6 days or less: No refund
6. Participant Requirements and Safety
6.1 Health Conditions
- Participation is not possible for persons with serious health conditions (e.g., heart disease, epilepsy, high blood pressure, pregnancy).
- Participants must be fit and generally healthy. Any health issues must be disclosed to the organizer in advance.
6.2 Participation Conditions
- Some activities have age or weight restrictions stated in the tour description.
- Participants must not be under the influence of drugs, alcohol, or other intoxicating substances. If the organizer detects such influence, the participant may be immediately excluded without refund.
6.3 Organizer Instructions
- Participants must follow the guide’s instructions or they may be excluded without refund.
- Each participant is fully responsible for their behavior during the activity.
- In cases of inappropriate, dangerous, or aggressive behavior, the participant may be immediately excluded from the tour without a refund.
7. Liability and Assumption of Risk
- Each participant is required to have travel insurance that covers the entire duration of the activity, including accidents, medical expenses, repatriation, baggage loss, and trip cancellation.
- If the participant does not have appropriate travel insurance, they may be denied participation without a refund.
- The company is not responsible for any losses, damages, or costs resulting from the lack of proper insurance.
- Seek Adventure is not liable for costs that would otherwise be covered by travel insurance if the participant failed to arrange such insurance.
- Seek Adventure is not responsible for injuries, harm, or death resulting from the participant’s own actions, failure to follow guide instructions, undisclosed health conditions, negligence, or any other conduct not attributable to the company.
7.1 Company Duties and Liability
- The company is committed to providing its services with professional care and responsibility, as expected from outdoor activity providers.
- The company is not responsible for services or products arranged by the customer outside this contract, even if provided by recommendation or referral.
- Nothing in these terms excludes the company’s liability for death or injury caused by gross negligence.
- Before the activity begins, participants may be required to sign a waiver of liability that includes safety instructions and confirmation of participation at their own risk.
7.2 Liability for E-Bikes
- Participants are responsible for any damage to the e-bike caused by careless, inappropriate, or negligent use (e.g., falling, crashing). Normal wear and tear is excluded.
- The participant shall cover the cost of repair for any damage they cause. Repairs will be arranged by Seek Adventure.
- In case of loss or theft of the e-bike during the activity, the participant must cover the full replacement cost.
8. Complaints
- If the complaint concerns accommodation or another service provided by a third party, the participant should first contact the provider directly and attempt to resolve the issue on site.
- If the issue cannot be resolved, the participant should immediately contact Seek Adventure to find an appropriate solution.
- In the event of dissatisfaction, a written complaint must be submitted within four weeks after the end of the activity, via email or another agreed method.
- If the participant fails to submit a complaint within this period, Seek Adventure accepts no liability for any claims, except those involving death or injury.
9. Data Protection
- Personal data provided by the participant at the time of booking is collected solely for the purpose of processing the booking and providing the agreed services.
- This data may be shared with third parties (e.g., accommodation providers, transport companies, other service providers) if necessary to fulfill the booked activities.
- By making a booking, the participant agrees that their personal data may be used and transferred to such third parties.
- Personal data will not be used for any other purpose unless expressly required by law.
- Participants can view the full privacy policy on the organizer’s website.
10. Governing Law
These terms are governed by Swiss law and disputes will be settled in Interlaken.
